Summer Sketch Competition 2016

1. The promoter

1.1 The promoter is: HS1 Limited of 12th Floor, One Euston Square, 40 Melton Street, London, NW1 2FD (“HS1”)

2. The competition

2.1 The title of the competition is Summer Sketch Competition 2016.

2.2 Entrants must use their artistic skills to draw a sketch of the view from the window (real or imaginary) within the space provided in the competition advert printed in the free daily Metro newspaper on 13 July, 19 July, 10 August and 7 September 2016.

2.3 The competition will run in four phases.  For your drawing to be entered in to any one competition phase, your entry must be submitted between the following times and dates of each relevant phase:

(a) from 00:01 on 13 July to 23:59 on 19 July 2016 to be judged in the first phase;

(b) from 00:01 on 19 July to 23:59 on 25 July 2016 to be judged in the second phase;

(c) from 00:01 on 10 August to 23:59 on 16 August 2016 to be judged in the third phase; and

(d) from 00:01 on 7 September to 23:59 on 13 September 2016 to be judged in the fourth phase.

2.4 Any drawings submitted between 00:01 and 23:59 on 19 July will be entered for judging in the first and second phases of the competition.

2.5 You may enter up to one drawing in to each phase of the competition.

2.6 All competition entries must be publically visible on Twitter under the hashtag “#summersketch” and tag HS1’s Twitter account “@StPancrasInt” by no later than 23:59 on the last dates set out in each of conditions 2.3(a) to (d). All competition entries received after the last date of each phase will be automatically disqualified from that competition phase.

2.7 To enter the competition:

(a) draw your sketch of the real or imaginary view from your window in the blank space provided in the promotional advert, to be published in the Metro newspaper on 13 July, 19 July, 10 August & 7 September 2016;

(b) take a photo of your sketch; and

(c) send out a public Tweet of your photographed sketch and do one or more of the following:

(i) follow @StPancrasInt on Twitter;

(ii) use the hashtag #summersketch; and/or

(iii) tag HS1’s Twitter account @StPancrasInt.

2.8 Participation in the competition can only take place online using a registered Twitter account and winners will only be selected from entries from accounts that follow @StPancrasInt. No applications to enter made in any other manner will be accepted.  

2.9 No purchase necessary.

2.10 HS1 will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

2.11 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

2.12 The competition entries will be judged by an independent judge based on the subjective interpretation of the creativity and originality of the sketch.  The decision of the judge (acting reasonably) will be final.  HS1 reserves the right to amend the criteria used to judge entries.

2.13 By entering the competition, you hereby warrant that all information submitted by you in your entry is true, accurate and complete in every respect. HS1 reserves the right to verify any information contained in your entry and/or your eligibility to enter the competition.

2.14 Entrants shall not submit any drawing that uses any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing overt brand sponsorship, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights).

2.15 HS1 reserve the right in its absolute discretion to disqualify any entrant if it has reasonable grounds to believe that an entrant has breached any of these terms and conditions, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with these terms and conditions could lead to HS1 disqualifying that person, without HS1 giving any reason for such disqualification or granting any opportunity for challenge.

2.16 In the event that a prize-winner is disqualified from the competition, HS1 will select an alternative prize-winner in the same manner as the original prize-winner and such selection will be subject to these terms and conditions.

3. Eligibility

3.1 The competition is only open to all residents in the UK, of any age.  It is deemed that the parent(s) or guardian(s) of any entrant that is aged under the age of 18 have consented to that person’s entry into the competition and these terms and conditions. Entrants may be required to provide proof of identity and if aged under 18, should be able to demonstrate to HS1’s satisfaction that their parent/guardian has given their consent to such entry.

3.2 Any person that is:

(a) an employee of HS1 or its holding or subsidiary companies;

(b) an employee of agents or suppliers of HS1 or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) a member of the immediate families or households of (a) and (b) above.
is not eligible to enter the competition. HS1 reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for the competition as a result of this condition.

3.3 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. HS1 may require you to provide proof that you are eligible to enter the competition.

3.4 HS1 will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

3.5 There is a limit of one entry per person, per phase. In the event that HS1 discovers or has reasonable grounds to believe that the same person has made multiple entries, such person and any entries made by them shall be disqualified and, if such entrant has already been selected as a prize-winner, an alternative prize-winner will be selected in accordance with condition 2.11.

3.6 HS1 reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
3.7 Competition entries cannot be returned.

4 The prize

4.1 The prize for each phase is all of the following:

(a) a family ticket (2 adults and up to 3 children under 18 years old) to see “The BFG in Pictures” exhibition at House of Illustration (open Tuesday to Sunday from 10am to 6pm, until 2 October 2016); and

(b) a copy of the new special limited edition of “The BFG” (released on 23 June 2016 and containing original illustrations), signed by Quentin Blake.

4.2 The prize is supplied by House of Illustration, 2 Granary Square, King’s Cross, London, N1C 4BH.   The prize is subject to availability. HS1 reserves the right to substitute the prize with a prize of equal or greater value.

4.3 There is no cash alternative for the prize.  The prize is not negotiable or transferable.

4.4 In order to claim the prize you must comply with condition 6.

5. Winner announcement

5.1 The winner of each phase of the competition will be announced by a public Tweet from @StPancrasInt on the following dates:

(a) 22 July 2016 in the case of the first phase;

(b) 29 July 2016 in the case of the second phase;

(b) 19 August 2016 in the case of the third phase; and

(c) 16 September 2016 in the case of the fourth phase,

(each, an “Announcement Date”).

5.2 The decision of the judge nominated by HS1 is final and no correspondence or discussion will be entered into.

5.3 HS1 will contact the winner personally as soon as practicable after each Announcement Date, with a reply Tweet sent to the winning account.  

5.4 HS1 will send the name and county of the winners to anyone who writes within one month after the Announcement Date of the fourth phase of the competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in condition 1.

6. Claiming the prize

6.1 If you are the winner of the prize, you will have 21 days from the Announcement Date to claim the prize by following @StPancrasInt and sending a direct message on Twitter to @StPancrasInt with your contact details, including your name, telephone number and email address. If you do not claim the prize by this date, your claim will become invalid.

6.2 The prize may not be claimed by a third party on your behalf.

6.3 HS1 will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 21 days of the Announcement Date, HS1 reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received.  

6.4 HS1 does not accept any responsibility if you are not able to take up the prize.

6.5 No prize will be awarded where any entrant has committed any form of misconduct (as determined by HS1 in its sole discretion).

7. Limitation of liability

Insofar as is permitted by law, HS1, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, disappointment, personal injury or death occurring as a result of any entrant entering this competition, taking up the prize, or as a result of any entrant winning or not winning any prize, except where it is caused by the negligence of HS1, its agents or distributors or that of their employees. Your statutory rights are not affected.

8. Ownership of competition entries and intellectual property rights

8.1 HS1 does not claim any rights of ownership in your competition entry.

8.2 You agree that HS1 (and any third party authorised by HS1) may use your entry (whether or not it wins the competition) for any promotional purpose (for example, placing it on the St Pancras website or on any poster, leaflet or other advertising media). You confirm that your entry is original that you own and have the right to license to HS1 the copyright and other intellectual property rights in the entry for the purposes referred to in these terms and conditions, but you give HS1 (and any third party authorised by HS1) your irrevocable permission to use, reproduce, publish, display, transmit, copy, amend, store, sell and sub-licence your entry worldwide for such promotional purposes and for the purposes of the competition.

8.3 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to HS1 all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

8.4 You agree that HS1 may, but is not required to, make your entry available on its our social media channels and websites and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant HS1 a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry  for such purposes.

9. Data protection and publicity

9.1 If you are the winner of the competition, you agree that HS1 may use your name, Twitter account name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.

9.2 You further agree to participate in any reasonable publicity required by HS1.

9.3 By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by HS1 and House of Illustration or their agents and suppliers to administer the competition.

10. General

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, HS1 may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2 In the event of any dispute regarding these terms and conditions, the conduct or results of the competition, or any other matter relating to a competition, the decision of HS1 shall be final and unchallengeable and no correspondence or discussion shall be entered into, comment issued, or reason given in respect of any decision made by HS1.

10.3 HS1 reserves the right to hold void, suspend, cancel, or amend all or any part of the competition where it becomes necessary to do so.  Any changes to these terms and conditions, or cancellation of the competition, will be posted on the St Pancras website. It is the responsibility of entrants to keep themselves informed as to any changes to the terms and conditions.

10.4 This competition is no way sponsored, endorsed or administered by Twitter.

10.5 These terms and conditions and any dispute arising out of or in connection with them or their subject matter (including any non-contractual disputes or claims) shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
